WORKER'S COMPENSATION

MASSACHUSETTS WORKER'S COMPENSATION LAW

Worker's compensation is a statutory benefit required under Massachusetts General Law Chapter 152. It provides a system by which injured workers or their families are paid weekly wage loss benefits for total and partial disability, death benefits, medical expenses, vocational re-training costs and many other additional benefits.

Worker's compensation benefits available in Massachusetts include:

•    Temporary total disability (Section 34) benefit
•    Partial disability (Section 35) benefits
•    Permanent and total disability (Section 34A) benefits
•    Medical Expenses
•    Surviving spouse (death) (Section 31) benefits
•    Vocational Rehabilitation
•    Permanent loss of function benefits
•    Scarring and Disfigurement benefits
•    Lump sum settlements
•    Section 28 double compensation – Employer’s willful misconduct

Our practice in the area of worker's compensation law focuses on representing injured workers and their family members. We have represented injured workers in a variety of fields including but not limited to the construction and building trades, service industry, health care industry, and manufacturing industry.

If you are injured on the job, speaking with a Worker's Compensation Attorney is essential.  One of the main reasons is that the insurance companies defending worker’s compensation claims have increased the resources they devote to defending your claim and limiting/eliminating the exposure of their insured.  There is no fee for the in initial consultations with our office. Additionally, if we are successful in obtaining benefits by way of filing a claim at the Department of Industrial Accidents, the Massachusetts Worker's Compensation statute provides the assessment of attorney’s fees and costs against the insurance company which has disputed an employee’s claim.
